Notarial Certification of Powers of Attorney and Declarations
In the consular service, the date, content, and signatures of private documents that are not subject to registration and are submitted by Bulgarian or foreign citizens can be certified if the document is written in Bulgarian. Furthermore, the accuracy of copies and extracts from documents presented by Bulgarian citizens can also be certified.
The certification of the date, content, and signature of a private document that is not subject to registration and is submitted by a foreign citizen is only carried out if the document is intended to have legal effect in the territory of the Republic of Bulgaria.
When transferring real estate or establishing property rights on real estate; transferring company shares (Ltd., EOOD); decisions of the general meeting of shareholders in Ltd.; capital decrease/increase; appointment of a manager; acquisition/disposal of real estate by Ltd., the power of attorney should be presented to the consular service in two identical copies.
In this case, simultaneous certification of the signature and content of the document is done. It is necessary to certify two copies of a declaration under Art. 264, para. 1 of the Obligations and Contracts Act (for real estate); two copies of a declaration under Art. 264, para. 2 of the Obligations and Contracts Act (for the transfer of motor vehicles), and one declaration under Art. 25, para. 8 of the Road Traffic Act.
When certifying a declaration for a child's travel outside the borders of the Republic of Bulgaria, the original birth certificate of the child and a photocopy must be presented.
